If our rights are "not unlimited" as liberals and even some non-liberals claim, why didn't the founders themselves say this? So what, the founder never said it. Whether you believe the Constitution is a living document or a dead one, various branches have various power, not stated in the Constitution, that are valid and legal. For example, the Supreme Court and other courts have the power of judicial review but that power is never stated in the Constitution. The Supreme court has used that power to set limits on the rights in the Constitution. It was the Supreme Court that decided the First Amendment did not cover some yelling fire in a crowd theater when there was no clear danger. It was the Supreme Court that set the conditions to criminalize the yelling in a theater.
Why do Republicans want to replace all of the heads of our federal programs with people who hate our federal programs? The right believes in and upholds the aspirations of the people. The left doesn't believe in the people, and instead upholds a government to determine an outcome for them. Too much government, as it is meant to do, drowns out the aspirations and abilities of the people. And lessening its burden on the people allows the people to prosper.
When and to what extent is it acceptable for the government to place the needs of the nation before the rights of the individual? Times of crisis and anything deemed "Eminent Domain." Also, thanks to the Supreme Court under President Clinton, ANYTIME the government thinks they can make more money by taking your land. True. If your local government decided it needs another Taco Bell, then they can seize your home for it. The Supreme Court so ruled.
Lefties, why are you rude to people who choose to identify themselves as "indigenous British"? Because if they accept that we are indigenous they'll have to give use the same rights as other indigenous peoples around the world. Here's a few reasons why they don't want that. Indigenous peoples, in exercising their right to self-determination, have the right to autonomy or self-government . Indigenous peoples and individuals have the right not to be subjected to forced assimilation or destruction of their culture. (Multiculturalism) Indigenous peoples and individuals are free and equal to all other peoples and individuals and have the right to be free from any kind of discrimination, ("positive discrimination") Indigenous peoples have the right to determine their own identity or membership. (New British would have to call themselves something else.)
Why are Americans allowed to have free speech? In the US, the Supreme Law of the Land is the US Constitution. The first amendment of the US Constitution and the first amendment of the Bill of Rights, guarantees "freedom of speech". So freedom of speech is the Supreme Law of the Land. There are limits to freedom of speech such as fraud, threatening somebody -- assault, crying "Fire!" in a crowder theater, inciting a riot. Advocating violence against a group of people is against the law, but saying that you think that gay sex is a sin is a religious belief. "Tyson Fury sparks controversy by saying homosexuality, abortion and paedophilia 'will cause the world to end'" Saying that homosexuality is wrong is not against the law in the US, but saying that people who engage in homosexual sin should be hurt is against the law in the US. Do you think the SCOTUS is ruling like a super legislature or interpret the laws? No. Also, someone can do something about it. Those someones are Congress and the President. In the system of checks and balances, the Supreme Court doesn't get the final say. The buck stops with Congress and then the President, for they can overrule anything the Supreme Court rules by passing an amendment to the US Constitution that contradicts the Court's ruling. That's ignoring the fact that the President and Congress have control over the Supreme Court on the front end because it is the President and Congress and only the President and Congress that appoint and confirm the justices of the Supreme Court. Nobody is on the Supreme Court that a President didn't nominate and a Congress didn't confirm. So the legislative and presidential electorate only have themselves to blame if judicial activism starts mitigating their acts, and they have the power to thwart it entirely, both preventatively and redressively.
